A new rumour suggests that it’s because of three specific legal issues that Eartbound has not made its way to the Virtual Console service. As for how these issues could be remedied:

  1. The Sky Runner song needs to be changed
  2. The Chuck Berry battle song needs to be changed
  3. The Dali’s Clock enemy name needs to be changed

Supposedly, those last two points are easy enough to change. With the first one though, the developers would have to make a new Sky Runner song, and:

…apparently NCL or someone else on the Japanese side of things isn’t happy with that or finds it too much of a bother, so the game has been in limbo for the past five years.

It’ll be a shame if this isn’t resolved at some point.

It seems, at least according to the ESRB website, that there are three Ninja Gaiden titles coming to the 3DS via the Virtual Console. The games are Ninja Gaiden, Ninja Gaiden II: The Dark Sword of Chaos, and Ninja Gaiden III: The Ancient Ship of Doom. We’ll have to wait and see, of course, but there’s been plenty of news shared by the ESRB in the past, so I wouldn’t see why this is any different.

Sonic Blast and Sonic Labyrinth, originally released for the GameGear, have been rated by the Australian Classifications Board. This seems to indicate that they will be the next GameGear Virtual Console releases, but we won’t know for sure until Nintendo makes an announcement.
